    Gadling initially applied for default bail in 2018 when Pune police were investigating the case.

    The Bombay High Court on Friday dismissed the pleas of five accused, including lawyer Surendra Gadling, in the Elgar Parishad Maoist-linked case for default bail or bail on technical grounds. .

    A division bench of Justices Ajay Gadkari and Shyam Chandak dismissed the application filed by Gadling, Shoma Sen, Mahesh Raut, Sudhir Dhawade and Rona Wilson.

    Detailed order is pending.

    Gadling initially applied for default bail in 2018 when Pune police were investigating the case.

    The application said the 90-day extension granted by the court to the police for filing the charge sheet was “illegal” and therefore the accused was entitled to bail under the Code of Criminal Procedure (CrPC).

    In his petition to the high court, Gadling claimed that the special court failed to consider the fact that the Pune court “had no jurisdiction to extend the time for completion of investigation”.

    Sixteen people were arrested in the case, including Jesuit Father Stan Swamy, who died in judicial custody at a private hospital.

    The case relates to inflammatory speeches delivered by Elgar Parishad at a conclave in Pune on December 31, 2017, which police claimed triggered violence near the Koregaon-Bhima War Memorial in Pune district the next day.

    The Pune police also claimed that the Maoists were behind the secret meeting. The investigation was later transferred to the National Intelligence Service.
