The Uttar Pradesh Assembly on Tuesday passed a bill to tackle malpractice in public examinations, making organized cheating punishable with up to life imprisonment and a fine of up to Rs 1 crore.
The Uttar Pradesh Public Examinations (Prevention of Unfair Means) Act, 2024 provides that a person shall be liable to imprisonment for life and a fine of not less than Rs 50 lakh (which may extend to Rs 10 million) irrespective of whether he is associated with a solver in connivance with a gang or Others use unfair means in public examinations.
The Bill seeks to address and identify factors that exploit vulnerabilities in the exam system. The bill says the crime will be investigated by the DSP or ACP.
The opposition demanded that the bill be referred to a select committee, but the request was rejected by the House and the bill passed by voice vote. Chief Minister Yogi Adityanath said, “An injustice done to the youth by cheating in public examinations is no less than any national sin and the state government is committed to taking strict action against those who attempt to take strict action action”. With their futures in mind, students and competitive candidates will be exempted from criminal liability but “decisive and strong action” will be ensured against the guilty.
Once the bill becomes law, it will take effect on July 15, 2024.
