A bench of Justices Bela M Trivedi and SC Sharma noted that the accused Mohan Nayak cooperated with the trial court in the proceedings and did not seek any adjournment.
“In this case, we have no intention to interfere with the impugned order passed by the High Court. However, the court of first instance is requested to proceed expeditiously and the parties should cooperate with the court of first instance in concluding the proceedings.
“It is self-evident that if the accused (accused) fails to cooperate or requires unnecessary extension or breaches any of the conditions, the State of Karnataka or the complainant shall be entitled to apply for cancellation of bail and if any such application is made, it shall be based on on its own merits and decided in accordance with the law,” the judge said.
Kavitha has moved the Supreme Court against the High Court order dated December 7, 2023.
Senior advocate Sidharth Luthra, appearing for Karnataka, told the court that the prosecution has so far examined 137 witnesses, of whom 137 have been withdrawn. The prosecution may also withdraw 150 witnesses, which now stands at about 100 Witnesses are still pending.
