In a letter, former Supreme Court Bar Association (SCBA) president Adish Aggarwala called the resolution invalid and asked Kapil Sibal to withdraw the resolution and issue a public apology within 72 hours, Failure to do so may result in a motion of no confidence
Former Supreme Court Bar Association (SCBA) president Adish Aggarwala has written to current president and senior advocate Kapil Sibal, warning him of the association's recent condemnation of the Kolkata rape and murder case The resolution will propose a “no-confidence motion” against him.
In his letter, Agarwala expressed serious concern over the resolution regarding the brutal rape and murder of a trainee doctor at RG Kar Medical College and Hospital in Kolkata. Agarwala said the resolution was not formally approved by the SCBA executive committee and was therefore invalid.
Agarwala also accused Sibal of using his position to undermine the seriousness of the incident and displaying a conflict of interest by handling related cases on behalf of the West Bengal government while making such statements.
“You have been representing the Government of West Bengal in relevant cases before the Hon'ble Supreme Court. As a lawyer, you have every right to accept cases and argue them. However, on August 21, 2024, you circulated a purported It was the SCBA's resolution that described the RG Kar Medical College incident as a “symptomatic malaise” and said the “resolution” hoped that such incidents happening across the country would be rectified.
“The statement on the 'SCBA Resolution' signed by you and printed on SCBA letterhead is mischievous, dangerous, insensitive and disrespectful to rape and murder victims and the hundreds of thousands of doctors, interns and doctors who are still protesting and demanding safety. This is a serious injustice to students.
The letter gave Sibal 72 hours to withdraw the resolution and issue a public apology. Failure to do so could result in a motion of no-confidence against Sibal.
Agarwala's letter criticized Sibal for trying to undermine the seriousness of the RG Kar Medical College case, which is under intense scrutiny by India's Supreme Court and the Central Bureau of Investigation.
Several members of the SCBA Executive Committee (EC) also expressed concern over the resolution issued by SCBA President Kapil Sibal regarding the incident at RG Kar Medical College and Hospital. They claimed that the resolution was signed by Sibal on August 21, 2024 and circulated on SCBA letterhead but was not submitted to the Executive Committee or the Executive Committee for approval.
