Justice M Nagaprasanna found the charges against the man to be trivial and stayed the investigation. In his ruling, the judge said continuing the investigation would constitute an abuse of legal process.
“Allowing any investigation against the husband would amount to an abuse of the legal process and would exacerbate the wife's allegations that she was not allowed to eat French fries at the relevant time. Therefore, all investigations against the husband should be subject to an interim stay order,” he explain.
The woman's husband, who works in the United States, was also allowed to return to work after he assured the court that he would cooperate with the investigating authorities and would not evade the investigative process.
The man's petition sought to halt the investigation, arguing the complaint was frivolous. His lawyer pointed out that after his wife filed a complaint, a Notice of Attention (LOC) was issued to him, preventing him from returning to the United States to work.
A court had previously suspended an investigation into the man's parents, who were also named in the indictment. The wife claimed in her complaint that soon after the child was born, her husband refused to let her eat French fries, rice and meat. The husband countered that during their stay in the United States before the birth of the child, the wife made him do all the household chores.
Justice Nagaprasanna criticized the use of LOC in this case, calling it an abuse of the legal system. He concluded that the complaint appeared to be frivolous and allowed the man to return to the United States to fulfill his professional obligations.
