A federal judge ruled Tuesday evening that the Environmental Protection Agency must immediately restart a $20 billion Biden-era green energy program, a federal judge ended last month, rebooting the flow of taxpayer funds to eight environmentalist groups, including one related to Georgia Democrat Stacey Abrams. Judge Tanya Chutkan of the District Court of the U.S. District Court of Columbia (appointed by former President Obama in 2013) issued a preliminary injunction that blocked Trump's EPA's actions, but did not immediately explain the ruling.
The plaintiff, a coalition of eight environmental organizations that the Biden administration has granted large amounts of grants under the program, demanded an injunction that the termination of the program would result in their irreparable losses.
The ruling is the latest explosion court has dealt with the Trump administration, which has failed in several court-ordered injunctions since January. It also provides a lifeline for a large number of environmentalist groups funded by taxpayers.
The EPA filed a Keuken ruling Wednesday morning.
The case involves the Biden administration's handling of the so-called greenhouse gas reduction fund, created under the Democratic Inflation Reduction Act of 2022.
In April 2024, the EPA announced that it had selected eight recipients to earn $20 billion in revenue under the program and used the money to strengthen the national green energy efforts.
The program was designed by Biden EPA as a “green bank” that uses delivery mechanisms to support local climate projects.
Shortly after taking office, EPA administrator Lee Zeldin's team found that Biden officials parked the $20 billion at Citibank, an external financial institution.
The first arrangement limits oversight of funds and creates obstacles to the Trump administration’s efforts to seize them.
