On Tuesday, U.S. District Court Judge Mary McElroy issued a ban on the Trump administration, ruling in favor of environmental groups, who claimed the president illegally freezes grants to combat what has been called “climate change, reduce pollution and modernize U.S. infrastructure.”
McElroy ruled: “The institution has no unlimited power to further the agenda, nor does it have no unlimited power to permanently train the two regulations adopted by Congress during the last administration.”
The Trump administration said the administration has the right to suspend funds granted to grants and redirect funds to more appropriate programs, and a Rhode Island judge lacks jurisdiction to hear the case.
The Justice Department also claimed that it has a stronger position as part of the Diversity, Equity, and Inclusion (DEI) initiative after the Supreme Court ruled that the Trump administration could cancel millions of dollars in teacher training grants.
But this is not the first time Judge McEroy has thwarted the Trump administration’s efforts to freeze grants on the government.
In early April, McElroy approved a request from Democratic state officials in Rhode Island to “temporarily prevent President Donald Trump’s administration from reducing state health grants.”
“If we stop this, the damage to the plaintiff's state and the plaintiff's agency is clearly irreparable,” McEroy said after a debate on behalf of lawyers at the state government and Trump's Department of Health and Human Services (HHS) division.
HHS has withdrawn more than $11 billion in grants to states.
McElroy has a wide history of democratic activities, These include:

“I participated in an election effort to encourage young people to register for voting and participate in the political process and support Democratic candidates,” she wrote in a Senate questionnaire.
President Barack Obama first nominated McElroy to take a seat in the U.S. District Court in the Rhode Island area in 2015.
Her nomination expired in 2017, and President Trump nominated her for the position in April 2018.
